Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Eve application or visiting helloeve.org (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Eve is an AI-powered cycle tracking and women’s health application that provides period tracking, fertility forecasting, symptom logging, Ava AI health conversations, and access to a provider directory. Premium features are available via paid subscription.

3. Account Registration

You may use certain features without an account. To access subscription features, cloud sync, and the provider directory, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscriptions and Payments

Eve offers free and premium tiers. Premium subscriptions are billed through Stripe. Prices are displayed before purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Refunds are handled in accordance with applicable law and Stripe’s policies. You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the integrity of the Service
  • Use automated means to access the Service beyond normal app usage

6. Health Information Disclaimer

Eve is a wellness and tracking tool, not a medical device. Ava AI provides health information for educational purposes only — it does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions. Eve is not liable for health outcomes based on information provided in the app.

7. Intellectual Property

The Service, including its code, design, content, and trademarks, is owned by Webb Labs (Webblabs LLC). You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes.

8. Additional Terms for Eve Providers

If you register or operate as a provider in the Eve ecosystem (including directory listings, provider portal usage, or related provider services), you agree to these additional obligations:

  • You represent that your licensing, credentials, and professional status are valid and current.
  • You are responsible for complying with all healthcare, privacy, and telehealth laws applicable to your jurisdiction.
  • You must provide accurate provider profile information and promptly update any material changes.
  • You are solely responsible for your professional advice, patient interactions, and clinical decisions.
  • You must not misuse patient information and may only use platform data for legitimate care and operational purposes.
  • We may suspend or terminate provider access if verification fails, policies are violated, or patient safety concerns arise.

Eve is a technology platform and does not provide medical advice or assume responsibility for services delivered by providers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBB LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time from Settings. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via in-app notification or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
